2. About these Terms
2.1 By accessing the Service, creating an account, submitting materials or placing an order, the customer agrees to these Terms and the policies incorporated by reference. A purchase becomes binding when payment is authorised and Art Persona issues an order confirmation. Conflicting customer terms do not apply unless GromeFeet OÜ accepts them in writing.

3.1 “Avatar” means the customised digital image or image set produced from customer instructions; “Customer Materials” means photographs, prompts, names and other content supplied by the customer; “Output” means the delivered avatar file; “Service” means the website, checkout, production workflow and support; and “Order” means the specific paid request described in the confirmation.
3.2 Customer instructions and later changes are assessed together; a material change requested after production starts may require a revised price or timetable.
4. Eligibility and account use
4.1 Customers must be at least 18 years old and legally capable of entering a contract. An account, where offered, is personal to the customer, must use accurate contact information and may not be sold, shared for abuse or used to conceal the identity of a payer. A parent or legal guardian must place any order intended for a minor.
5. Scope of licence and permitted use
5.1 After full payment and delivery, Art Persona grants the customer a worldwide, perpetual, non-exclusive licence to use, reproduce, display and adapt the Output for lawful personal or commercial purposes. The licence does not transfer Art Persona production tools, templates, software, training methods or third-party materials, and it is conditioned on respect for the rights of every depicted person.

6. Custom avatars and digital content
6.1 Each Output is personalised digital content produced from Customer Materials and creative or algorithmic processing. Visual similarity is interpretive rather than forensic; minor differences in style, colour, crop, pose or facial detail are not defects if the Output materially follows the selected package and instructions. Outputs are not identity documents, biometric verification tools or guarantees of an exact photographic likeness.
7. Purchases, billing and taxes
7.1 Prices are displayed in euros and the total payable amount, including applicable value-added tax, is shown before the customer authorises payment. Art Persona may correct an obvious pricing error before production begins, but it will not charge a higher amount without renewed consent. The card statement descriptor is ART PERSONA, and foreign-exchange or issuer fees are controlled by the customer’s bank.
7.2 Where a rule depends on timing, Art Persona uses the payment confirmation, production milestone and verified delivery event rather than an informal estimate.
8. Delivery of digital content
8.1 Delivery occurs electronically by account access, secure download link, email attachment or another method stated in the order confirmation. The normal production window is one to five business days after cleared payment and receipt of complete, usable Customer Materials. Delivery is complete when the file or functioning access link is made available to the verified account or email address.
9. No physical shipping or stored value
9.1 The Service supplies digital files only. No product is shipped, no delivery address is required unless needed for payment verification, and no purchase creates money, electronic money, stored value, a deposit or a cash-equivalent balance. Any promotional credit can be used only within the stated campaign and cannot be redeemed, transferred or withdrawn as cash.
9.2 Safety or rights concerns may be escalated for manual review, with access restricted only to the extent reasonably required.
10. Customer instructions and cooperation
10.1 The customer must provide clear instructions, technically suitable images and timely responses to reasonable clarification requests. Production time may pause while information is incomplete or while Art Persona awaits consent to a material change. The customer is responsible for reviewing previews or proofs where the purchased package includes them; silence after a stated review deadline may be treated as approval only where this was clearly disclosed in the order flow.
10.2 No clause excludes liability or rights that cannot lawfully be excluded.
11. User conduct and prohibited activity
11.1 The Service may not be used for fraud, harassment, defamation, illegal discrimination, impersonation, identity deception, non-consensual intimate imagery, sexualised depictions of minors, extremist propaganda or evasion of another platform’s safeguards. Users must not probe, scrape, overload, reverse engineer or bypass security, payment, rate-limit, access-control or content-safety measures.
11.2 The Order confirmation, selected package and checkout disclosures determine the commercial scope; customers should retain them and report a material mismatch promptly.

12. Customer Materials and consent of depicted persons
12.1 The customer represents that each uploaded photograph or prompt is lawfully controlled and that every identifiable person has authorised the requested transformation and intended use. Public availability of an image does not by itself establish permission. Art Persona may request evidence of consent or refuse an order involving a public figure, a minor, intimate content, sensitive context or a credible risk of deception.
13. Intellectual property
13.1 Art Persona retains all rights in the website, brand, production systems, reusable design elements and know-how. The customer retains rights in Customer Materials and receives the Output licence stated above. To perform the Order, the customer grants GromeFeet OÜ and its processors a limited, revocable, worldwide licence to host, reproduce, modify and transmit Customer Materials solely for production, support, security and legal compliance.

14. Updates, maintenance and changes to the Service
14.1 Art Persona may update workflows, file formats, safety filters, processors and technical requirements to maintain quality, security or compliance. A change will not materially reduce a paid Order without offering a reasonable alternative, correction or remedy. Temporary maintenance may delay access, but completed Output files should be downloaded and securely backed up by the customer.
15. Suspension, restriction and termination
15.1 Art Persona may pause production, block access or terminate an account where payment is reversed, identity or consent is doubtful, materials appear unlawful, the Service is attacked, or these Terms are materially breached. Except for urgent safety or fraud cases, Art Persona will ordinarily explain the reason and provide a reasonable opportunity to respond. Termination does not entitle a customer to benefit from unpaid or fraudulently obtained Output.

16. Consumer rights and statutory protections
16.1 Nothing in these Terms excludes rights that cannot lawfully be excluded. Digital content must conform to the description, possess the agreed functionality and quality, and be supplied without undue delay. Depending on the circumstances, mandatory remedies can include bringing the content into conformity, replacement, proportionate price reduction, contract termination or refund.
17. Withdrawal rights for personalised digital content
17.1 Where European Union consumer law provides a fourteen-day withdrawal right, the checkout may ask the customer to request immediate performance and acknowledge that the right is lost once supply of the digital content begins or is completed, to the extent permitted by law. Custom-made content may also fall within a statutory exception. If the required consent or confirmation was not properly obtained, the customer retains the rights given by law.

18. Refunds and billing disputes
18.1 Eligibility, evidence, service levels and payment reversals are governed by the Refund Policy and Payment Policy. A granted refund is returned to the original payment method unless law or the payment provider requires another route. Once a full refund is issued, the customer’s licence to the refunded Output ends, hosted access may be removed and the customer must stop using and delete copies, except where law provides otherwise.
19. Disclaimers and service availability
19.1 Art Persona will use reasonable skill and care but does not promise uninterrupted access, artistic satisfaction beyond the agreed specification, compatibility with every device or acceptance of an Output by a third-party platform. Preview colours can differ between screens and print processes. Any disclaimer is limited by mandatory law and does not apply to fraud, wilful misconduct, personal injury caused by negligence or other liability that cannot be restricted.
19.2 Safety or rights concerns may be escalated for manual review, with access restricted only to the extent reasonably required.
20. Limitation of liability
20.1 For business customers, aggregate liability arising from an Order is limited to the amount paid for that Order, except for liability that cannot be limited. For consumers, Art Persona remains responsible for foreseeable loss caused by breach or failure to use reasonable care, while it is not responsible for remote, speculative or avoidable loss, third-party platform decisions, misuse of Output or loss caused by inaccurate Customer Materials.
20.2 No clause excludes liability or rights that cannot lawfully be excluded.
21. Indemnity for unlawful materials
21.1 A business customer must indemnify GromeFeet OÜ against third-party claims, regulatory costs and reasonable legal expenses caused by Customer Materials or use of Output that infringes rights or violates law, provided Art Persona promptly notifies the customer and permits reasonable participation in the defence. This clause does not apply to consumer liability beyond what applicable law permits and does not cover Art Persona’s own breach.

22. Privacy, cookies and data handling
22.1 Personal data is processed under the Privacy Policy and browser technologies under the Cookie Policy. Facial images are used to create the requested avatar and are not used by Art Persona for unique biometric identification. Payment-card data is entered into the payment provider’s secure environment; GromeFeet OÜ does not intentionally store full card numbers or security codes.
23. Complaints and support
23.1 Complaints should be sent to info@art-persona.com with the order number, a clear description and the remedy sought. Art Persona aims to acknowledge substantive complaints within two business days and provide a reasoned response within ten business days, subject to complexity. An Estonian resident consumer may apply to the Estonian Consumer Disputes Committee after first attempting resolution with Art Persona.

24. Governing law and dispute resolution
24.1 These Terms are governed by Estonian law. The courts of Estonia have jurisdiction, but a consumer may also rely on mandatory protections and competent courts available in the consumer’s country of habitual residence. The parties should first use the complaint process in good faith. The former European Union Online Dispute Resolution platform has been discontinued and is not used as a complaint channel.
25. Changes to these Terms and contact
25.1 Art Persona may amend these Terms for legal, security, technical or service reasons. The current version applies to new Orders; a material adverse change will not retrospectively alter a completed Order without a lawful basis. Questions, notices and formal complaints may be sent to the contact details in the Operator table, and electronic notices are effective when sent to the verified address associated with the Order.

Before ordering
• Use a clear image that you own or are authorised to use, and obtain consent from every identifiable person.
• Select the package and style carefully; custom production follows the confirmed brief, not an unstated expectation.
• Check the total in euros, the ART PERSONA statement descriptor and the delivery email before payment.
During production
• Respond promptly to a request for clarification; the delivery estimate pauses while essential information is missing.
• Do not send passwords, full card details or unrelated identity documents through support.
• A safety, consent or payment review can pause production without creating a completed delivery.
After delivery
• Download and back up the Output, review it against the confirmed package and report a material defect promptly.
• Use the Output lawfully and do not represent it as official identification, verified evidence or another person’s endorsement.
• Contact Art Persona before a chargeback where a delivery, revision or billing issue can reasonably be resolved directly.
